Terms Agreement

NDA CLAUSE
By enrolling, you acknowledge that this experience includes access to proprietary relationships, processes, and information that have been built over years of trust. You agree to honor all non-disclosure agreements, ethical boundaries, and shared respect for the people and partnerships involved — protecting not only this container, but those who came before and those who will come after you.

This Full Liability Waiver, Assumption of Risk, and Terms Agreement (“Agreement”) is entered into by the undersigned participant (“Participant”) in connection with participation with the Rachel Nixon Stitch Queen Brand (“Experience”), organized and facilitated by Rachel Nixon, and all affiliated entities, representatives, contractors, assistants, guides, hosts, vendors, and assigns (collectively, “Released Parties”).

1. NON-REFUNDABLE / NON-TRANSFERABLE POLICY
All payments made toward the Experience are strictly non-refundable and non-transferable, including but not limited to deposits, payment plans, and paid-in-full purchases. Participant acknowledges that the Experience requires significant planning, contractual commitments, and non-recoverable costs. No refunds will be issued for any reason, including but not limited to illness, injury, personal circumstances, visa issues, travel disruptions, government restrictions, acts of God, pandemics, or force majeure events. Participants remain financially responsible for the full cost of the experience, regardless of whether they participate or complete it.

2. INTERNATIONAL TRAVEL RISKS & ASSUMPTION OF RISK
Participant understands and acknowledges that international travel involves inherent risks including, but not limited to, transportation risks, health risks, exposure to illness or disease, accidents, political instability, civil unrest, government actions, language and cultural barriers, food and water safety concerns, differing safety standards, natural disasters, acts of terrorism, and acts or omissions of third parties. Participant voluntarily assumes all such risks, known and unknown, including the risk of serious bodily injury, permanent disability, or death.

3. PASSPORT, VISA & LEGAL COMPLIANCE
The participant is solely responsible for obtaining and maintaining a valid passport, any required visas, vaccinations, and for complying with all local, national, and international laws and regulations. Failure to obtain or maintain required documentation does not entitle Participant to a refund.

4. RELEASE OF LIABILITY & INDEMNIFICATION
To the fullest extent permitted by law, Participant hereby releases, waives, discharges,
indemnifies and holds harmless the Released Parties from any and all claims, demands, causes of action, damages, losses, liabilities, costs, or expenses, including attorneys’ fees, arising out of or related to participation in the Experience, including but not limited to claims based on negligence, personal injury, illness, emotional distress, property damage, loss, or death.

5. THIRD-PARTY PROVIDERS
Participant acknowledges that the Experience may involve independent third-party service providers, including airlines, transportation companies, lodging providers, factories, restaurants, and tour operators. The Released Parties do not control these providers and are not responsible or liable for their acts, omissions, delays, errors, or failures.

6. MEDICAL RESPONSIBILITY & INSURANCE
Participant is solely responsible for determining their physical and mental fitness to participate. The participant agrees to obtain adequate travel, medical, and emergency evacuation insurance and to carry the necessary medications and supplies. No medical services or insurance are provided by the Released Parties.
 

7. BEHAVIOR, SAFETY & REMOVAL
Participant agrees to behave responsibly and comply with all safety instructions. The Released Parties reserve the right to remove Participant from the Experience, at Participant’s sole expense and without refund, for behavior deemed unsafe, disruptive, illegal, or harmful to others or the integrity of the Experience.
 

8. FORCE MAJEURE
The Released Parties shall not be liable for any delay, modification, interruption, or cancellation of the Experience due to events beyond their reasonable control, including but not limited to acts of God, war, terrorism, pandemics, government actions, labor disputes, transportation disruptions, or natural disasters. Such events do not entitle Participant to a refund.
 

9. GOVERNING LAW & JURISDICTION
This Agreement shall be governed by and construed in accordance with the laws of the State of California. Any disputes shall be resolved exclusively in the courts located within California.

10. ACKNOWLEDGMENT & ELECTRONIC ACCEPTANCE
By completing electronic purchase and enrollment, Participant acknowledges that they have read, understood, and voluntarily agree to this Agreement. Participant understands this document is legally binding and intended to be as broad and inclusive as permitted by law.
